  1. Overview

The following privacy notice (“Privacy Notice”) describes the way we handle date and information learned about you from your visits to our websites that link to this Privacy Notice (the “Site”).

iECURE is headquartered in the United States and our Sites are operated in the United States in accordance with laws of the United States. Additionally, iECURE Inc, as the Controller, hereinafter as “iECURE”, “we” or “us”, of the personal data, has committed to comply with:

  • The General Data Protection Regulation N°EU 2016/679 (hereinafter, the “GDPR”).
  • And all EU applicable laws and regulations regarding data protection.

Collectively referred as “Data Protection Laws.”

With this Privacy Notice, we want to make sure that you understand what Personal Information is collected about you, how your Personal Information is used and how it is kept safe.

General warning and use of social media

Access to the Sites imply your full and unreserved acceptance of this Privacy Notice as well as its general terms of use and the Cookies Notice. By engaging with the Sites, you acknowledge having read the information below. The Privacy Notice is valid for all pages hosted on the Sites. It is not valid for the pages hosted by third parties to which we may refer and whose privacy notices may differ. We cannot therefore be held responsible for any data processed on these websites or by them. This Privacy Notice also applies to any other Sites that we may operate, including our Company pages on LinkedIn.

Please, note that for the use of social media, we will be Joint-Controller with LinkedIn only for the following activities: accessing and processing statistical aggregate data provided by LinkedIn. For any other processing on the platform, social media platform shall be considered as the sole Data Controller. LinkedIn have created an “addendum” to their user agreements for company pages for the processing for which they are Joint-Controllers with us.

  1. What information do we collect?

We collect ” Personal Information ” from and about you. Personal Information includes any information that identifies, relates to, describes, or is reasonably capable of being associated, or reasonably linked or linkable with a particular individual or household. The Personal Information collected through the Sites Include:

  • Personal Information you share with us;
  • Personal Information obtained automatically when you use our Sites, including through logging and analytics tools (e.g., cookies and pixels);
  • Personal Information from third-party sources.

We may also collect data that is not identifiable to you or otherwise associated with you, such as aggregated data, and is not Personal Information. To the extent this data is stored or associated with Personal Information, it will be treated as Personal Information; otherwise, the data is not subject to this Privacy Notice.

  1. How do we process personal information?

We process your Personal Information as part of our operations, which include:

  • Managing your inquiries, responding to inquiries and requests via email, and communicating with you through any newsletters or other updates;
  • Operating, maintaining, and improving the quality of the Site and such content, products and/or services as we may make available through the Sites;
  • Recruiting activities, including assessing your qualifications and/or capability for a particular job, role, or task and processing pre-employment background checks;
  • Compliance with applicable laws, regulations, rules and requests of relevant law enforcement and/or other governmental agencies;
  • Endeavoring to protect our and our partners’ rights, property, or safety, and the rights, property, and safety of our users and other third parties;
  • For other purposes, as permitted or required by law.

Depending on the purpose for which we need to process your personal data, we will keep them for no longer than necessary to fulfill the purposes for which we collected it, including any legal requirements.

  1. Data sharing

We do not sell or trade to outside parties your personal data. Nevertheless, we may share your contact information and/or usage information with our third-party service providers, such as those who provide email and web hosting services, and those who assist us in operating our Sites. We may share Personal Information we collect with certain affiliates, partners, prospective partners, and service providers for purposes of entering into new business relationships; and we share personal information with third parties when we believe it is required by, or necessary to comply with, applicable law.

Sharing your personal data as explained above may involve a transfer of personal data to a country outside the European Economic Area (EEA), we are therefore committed to complying with the transfer rules under applicable Data Protection Laws and therefore ensure to:

  • Transfer your data to countries where the data recipient is located that has been recognized as adequate by the European Commission, or
  • Where a country has not received an adequacy decision from the European Commission, to implement appropriate safeguards, such as the EU Standard Contractual Clauses (“SCCs”).

  1. How do we protect your information?

We treat your personal data in a confidential manner and provide for a sufficient and adequate level of protection of your personal data. Your personal data are contained behind secured networks and are only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential.

We may reference or provide links to third-party websites and services. When you access these third-party services, you leave our Services, and we are not responsible for, and do not control, the content, security, or privacy practices employed by any third-party websites and services. You access these third-party services at your own risk. This Privacy Notice does not apply to any third-party services; please refer to the privacy notice or policies for such third-party services for information about how they collect, use, and process personal information.

  1. Other important information about personal information and our Sites

No one under age 16 may provide information on our Sites. Our Sites are not directed at minors under 16 and we do not knowingly collect, maintain, disclose, or otherwise process Personal Information of minors below the age of 16 without the permission of such minor’s parents or legal guardians.

  1. Your rights

You have the ability to make certain choices about how we communicate with you, and how we process certain personal information.

  • Opting Out of Certain Communications. You can opt out of receiving promotional emails from us at any time by clicking on the unsubscribe link in our emails or by sending an email to us at that address set forth in the Contact Us section below. Please note that your opt-out is limited to the email address used and will not affect subsequent subscriptions or non-promotional communications, such as administrative and service announcements.
  • Text Messages. You may opt out of receiving text messages from us by following the instructions in the text message you have received from us or by otherwise contacting us.
  • Do Not Track. Our Site does not support Do Not Track at this time. Do Not Track (DNT) is a privacy preference that you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page.   • Third-Party Analytics. We may use third-party analytics providers, including Google Analytics⁠ (see Cookies Notice) to evaluate your use of our Site. We use these tools to help us understand use of, and to improve, our Site, our services, and user experiences. You can control and/or delete cookies as you wish – for details, see https://www.aboutcookies.org/. You can delete all cookies that are already on your computer and you can set most browsers to prevent them from being placed. If you do this, however, you may have to manually adjust some preferences every time you visit a Site and some services and functionalities may not work as intended.

If you are an EEA resident, this Notice is intended to provide certain information to you as required by the GDPR. As applicable to EEA residents, references to “Personal Information” in this Privacy Policy include “personal data” governed by European data protection legislation. For information about our collection, use, and disclosure of your Personal Information, please see the sections above. According to the GDPR, you have the following rights subject to limitation as set forth by applicable data protection law:

  • You have the right to obtain confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, information related to the processing of data and a copy of the data being processed.
  • You have the right to require rectification of inaccurate or incomplete data about you.
  • Right to be forgotten. To obtain the deletion of your personal data under certain specified circumstances.
  • Restrict processing. You have the right to restrict processing of data under certain specified circumstances.
  • Data portability. You have the right to request for the receipt or the transfer to another organization, in a machine-readable form, of your personal data.
  • Object to processing. You have the right to object, on grounds relating to your particular situation, at any time to the processing of your data.
  • Right to withdraw consent. When you have given your explicit consent for the processing of your data, you can withdraw it at any time without any cost nor justification.

Please note that all these rights are not absolute and will be assessed on a case-by-case basis by our DPO. If you would like to exercise your rights, please let us know by contacting our DPO, iecure.dpo@mydata-trust.info. You have also the right to lodge a complaint if you consider that your personal data is not processed in accordance with the GDPR. You have the right to lodge a complaint with the Supervisory Authority in the Member State of the European Union of your habitual residence, place of work or place of the alleged infringement.

If you are a California resident, this Notice is intended to provide certain information to you as required by the California Consumer Privacy Act of 2018 (“CCPA”). For information about our collection, use, and disclosure of your Personal Information, please see the sections above. As applicable to California residents, references to “Personal Information” in this Privacy Policy include “Personal Information” governed by the CCPA.

You have the right to request that we disclose certain information to you about our collection of your Personal Information. Upon our receipt of your verified request, we will provide you with:

  • The categories of Personal Information we have collected about you.
  • The categories of sources from which we have collected your Personal Information.
  • Our business or commercial purpose for collecting your Personal Information.
  • The categories of third parties with whom we have shared your Personal Information.
  • The specific pieces of Personal Information we have collected about you.

You have the right to request that we disclose certain information to you about our disclosures and sales of your Personal Information; however, we do not sell Personal Information. Upon our receipt of your verified request, we will provide you with:

  • The categories of Personal Information we have collected about you; and
  • The categories of Personal Information that we disclosed about you for a business purpose.

You have the right to opt-out of the sale of your Personal Information; however, we do not sell Personal Information.

You have the right at any time to request that we delete your Personal Information.

We will not discriminate against you for exercising your rights. This generally means we will not deny you goods or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality for goods.
